1. Introduction

1.1 Purpose

Welcome to Terrain. These Terms and Conditions establish the rules for using our route planning services, promoting fairness and transparency for everyone who uses our platform.

1.2 Acceptance

By accessing or using Terrain, you agree to be bound by these Terms and Conditions. Your continued use of the platform constitutes your acceptance of these terms. If you do not agree, please discontinue use immediately.

2. User Rights and Responsibilities

2.1 User Conduct

Users are expected to engage in respectful and lawful behaviour on our platform. You agree not to use Terrain to engage in any unlawful activity, transmit harmful content, attempt to gain unauthorised access to other accounts or systems, or interfere with the integrity or performance of the service. Violations may result in suspension or termination of your account as outlined in Section 7.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Terrain uses passwordless authentication via one-time email codes. You must notify us immediately at hello@terrainhq.app if you suspect any unauthorised access to your account.

3. Service Description

3.1 Overview of Services

Terrain is a field sales route planning tool that allows users to build multi-stop routes, optimise stop order for efficiency, and share routes via public links that can be opened in Google Maps or Apple Maps — no recipient account required. Features are subject to change as the product evolves.

3.2 Modifications

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice, for reasons including maintenance, improvement, or compliance with legal requirements. We will make reasonable efforts to notify users of significant changes that materially affect their use of the platform.

4. Payment Terms

4.1 Fee Structure

Access to certain features of Terrain requires a paid subscription. By subscribing, you agree to pay the applicable fees as displayed at the time of purchase. All payments are processed securely by Stripe. We accept major credit and debit cards. Prices are displayed in USD and are subject to change with notice.

4.2 Billing Policies

Subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected) and will automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused time unless required by applicable law.

5. Privacy

5.1 Data Handling

We handle your personal information as described in our Privacy Policy, which is incorporated into these Terms by reference. By using Terrain, you also consent to the data practices described in that policy.

5.2 Cookies

Terrain uses cookies and similar technologies to maintain your authenticated session, remember your preferences, and collect aggregated analytics about how the service is used. By using Terrain, you consent to the use of cookies in accordance with our Privacy Policy. You may control cookie behaviour through your browser settings, though disabling certain cookies may affect the functionality of the platform.

6. Intellectual Property Rights

6.1 Ownership

Terrain and all its associated content — including but not limited to software, design, branding, logos, and text — are the exclusive property of Terrain or its licensors. Nothing in these Terms grants you ownership of or a licence to use our intellectual property beyond what is strictly necessary to use the service as intended.

6.2 User Content

You retain ownership of the content you create on Terrain, including route names, stop addresses, and other data you input. By using the platform, you grant Terrain a limited, non-exclusive, royalty-free licence to store, process, and display your content solely for the purpose of operating and improving the service. We do not sell your content to third parties.

7. Termination and Suspension

7.1 Grounds for Termination

We may suspend or terminate your account at our discretion if you violate these Terms, engage in unlawful activity through the platform, abuse or misuse the service in a manner that harms other users or Terrain, or fail to pay applicable subscription fees. We will make reasonable efforts to notify you before taking action unless doing so would pose a security risk or is prohibited by law.

7.2 Consequences of Termination

Upon termination, your access to your account and all saved routes will be revoked. Any public share links associated with your account may also be deactivated. Terrain is not liable for any loss of data following termination. You may request an export of your data prior to account closure by contacting us at hello@terrainhq.app.

8. Dispute Resolution

8.1 Resolution Methods

In the event of a dispute, we encourage you to contact us first at hello@terrainhq.app so we can attempt to resolve the matter informally. If a resolution cannot be reached through direct negotiation, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. Class action lawsuits and jury trials are waived to the fullest extent permitted by law.

8.2 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
